It certainly has been a mixed year for online gambling in the US, with 2025 initially appearing to give the image of a country on the verge of a breakthrough. However, it is no advisable to keep the champagne on ice and no celebrate prematurely. In April, a group of ten lawyers and academics gathered together to commence the planning of a lawsuit to combat online gaming and gambling addiction. The group gathered together in the US city of Indianapolis and were said to have made significant headway in their planning. A significant portion of the group consisted of product liability lawyers, so operators clearly have some tough opposition to deal with.
The beginnings of the group's legal strategy was based on the class action lawsuits that so successfully targeted Big Tobacco – those suits generated $206 billion during a quarter of a century. While the initial meeting was attended by just ten people, it is expected that more will rally behind the cause. In fact, over 20 were invited to the April meeting but not all could attend. A number of the lawyers invited had direct experience fighting against Big Tobacco, thereby highlighting their lack of fear against larger entities.
A major factor still to affect the anti-gambling group will be past precedents. Most notable of them would have to be a federal appellate from 2025 in which it was ruled that gamblers could not gather together to form one group. The reason why this was deemed to be the case is because all gamblers do so for different reasons. An attorney from Canada, Lori Stoltz, already representing 10,000 problem gamblers north of the border, was enlisted to participate in the April meeting. It is only expected that this dispute will carry on for some time to come.
What makes it an up and down year for online gambling is that Nevada legalised the activity back in February. It was expected that this would signify a slow changing in attitudes whereby the philosophy of playing games online would be accepted. New Jersey and Delaware were to be next in line, but now it wouldn't be surprising if operators chose to avoid what is expected to become a difficult situation. The online operators have not yet begun to trade, and already the lawsuit will be waiting for them.
